The court recently ruled in favour of a former Lobels (Private) Limited employee, awarding him damages following a wrongful accusation and subsequent arrest over alleged theft. This case, which unfolded in Harare’s court system, concluded with a ruling that Lobels acted with malice in prosecuting the ex-employee.
Timeline of Events Leading to the Case
Chauke’s difficulties began in October 2022, when his former employer, represented by Nyasha Nyakurera, alleged that he had misappropriated US$35,423.27 from the company. According to the claims, Chauke was accused of collecting this amount from customers, banking only US$2,184.00, and keeping the remaining US$33,751.27 for personal use.

The accusations led to Chauke’s arrest, subsequent detention, and a trial at the Mbare Magistrates Court, where he was charged with theft of trust property. During the trial, the State presented its case and brought forward three witnesses in an attempt to substantiate the charges. However, the evidence presented failed to support the claims.
Acquittal and Resolution of the Case
After nearly a year, on October 5, 2023, Magistrate Musaiona Shortgame ruled in favour of Chauke, acquitting him because the State did not establish a prima facie case. The acquittal brought an end to Chauke’s prolonged ordeal, confirming his innocence.
