I got $250 ticket but I was only obeying crossing guard’s orders – I took battle to court & won due to little-known code

A FURIOUS driver has claimed they got a $250 ticket unfairly despite following the crossing guard’s orders – but they were able to take authorities on and win.

Susan Kennedy-Spain got the ticket as she passed a line of school buses, despite being waved on by the crossing guard.

She challenged the $250 ticket in court and won

The driver was passing Patrick Henry School of Science and Arts near her home in Richmond, Virginia when she got the ticket.

As she waited behind the line of school buses parked outside, a crossing guard raised his arm and gestured for Susan to drive on.

“I’ve never seen the arm up when those buses are sitting on the side of the road, and I’ve been by there a hundred times,” she told CBS affiliate WTVR.

“I guess some of the buses have the arm thing out, even though they’re not doing anything. But I got a ticket.”

Susan reached out to the company that gave her the ticket but still hadn’t heard back a month later.

It was then that she went to court in early spring this year to challenge the ticket.

She soon discovered that she wasn’t alone in getting an “unfair” ticket.

“The place was filled with people contesting bus tickets,” she said. “That’s why we were all there. And everyone had similar stories.”

Susan didn’t have any representation, but she was still able to get out of the ticket thanks to a crucial piece of evidence in her favor.

After police showed the judge a video of her passing the school bus, with the crossing guard directing traffic, there was no option but to let her off.

“The crossing guard is the one that’s directing traffic,” she explained. “It says in the code that if a person of authority, like a crossing guard or a police officer, waves you through, then that kind of circumvents the bus and the arm.”

Bus Alert is the company that Richmond Public Schools says issues the tickets.

Richmond Police says a sworn officer reviews every ticket that Bus Alert issues.

Money made by the tickets goes back to Bus Alert while some of it goes to Richmond Public Schools.

Laws on Passing a School Bus

According to the National Highway Traffic Safety Administration (NHSTA), it’s illegal in all 50 states to pass a school bus when it is stopped, the red strobe lights are flashing, and the stop sign is deployed.

“All States require the traffic in both directions to stop on undivided highways when students are getting on or off a school bus,” the agency’s website reads.

Florida launched a program in May 2024 that will cite drivers illegally passing stopped school buses with the help of AI-powered cameras to capture footage of violators, citing an important law.

In Florida, Chapter 316 Title 19 reads:

  • Any person using, operating, or driving a vehicle on or over the roads or highways of this state shall, upon approaching any school bus which displays a stop signal, bring such vehicle to a full stop while the bus is stopped, and the vehicle shall not pass the school bus until the signal has been withdrawn. A person who violates this section commits a moving violation, punishable as provided in chapter 318.
  • Any person using, operating, or driving a vehicle that passes a school bus on the side that children enter and exit when the school bus displays a stop signal commits a moving violation, punishable as provided in Chapter 318, and is subject to a mandatory hearing under the provisions of s. 318.19

It is illegal to pass a stopped school bus when the stop sign is deployed and its red strobe lights are flashing in all 50 US states.

But many drivers have complained about the way the law is applied.

In September, a driver fined $275 for passing a bus complained his view was blocked by a truck.

Scott Janowski from Greece, New York tried to request a hearing but was denied.

While in Georgia, minimum fines for passing school buses quadrupled to $1,000 this year.

It says in the code that if a person of authority, like a crossing guard or a police officer, waves you through, then that kind of circumvents the bus and the arm.

It came after the state’s House of Representatives passed Addy’s Law, a bill named after eight-year-old Adalynn Pierce, who was struck and killed by a car as she crossed the street next to a school bus.

Five infant deaths force recall of baby swing sold at Walmart as company is slammed over $25 refund after tragedies

FISHER-Price has been blasted for offering parents just $25 to get rid of a deadly baby swing.

The mega-company recalled two components of its Snuga Swings on Thursday, telling customers they would get the cash if they “remove and destroy” the deadly parts.

The swings, sold at Amazon, Walmart and Target for $160, are designed to soothe little ones by swaying them back and forth.

But the items have been linked to five infant deaths between 2012 and 2022, all caused while the babies slept.

In most of those cases, the babies were unrestrained and bedding was added to comfort them – something Fisher Price says can ramp up the risk of suffocation. 

“The swing should never be used for sleep and bedding materials should never be added to it,” the company said in the recall announcement.

“If the product is used for sleep or bedding material is added, the headrest and body support insert on the seat pad can increase the risk of suffocation.

“Consumers should immediately remove both the headrest (by cutting the tether) and the body support insert from the seat pad before continuing to use the swing for awake-time activities.”

It added that Fisher-Price will “provide a $25 refund to consumers who remove and destroy the headrest and body support insert.”

And it urged parents to never use any inclined seated products, such as swings, gliders, soothers, and rockers, for infant sleep or leave their children in the products unsupervised.

Fisher Price, however, has since come under fire for not doing enough for customer safety.

“I believe that the flawed recall that Fisher-Price is announcing today is doomed to fail and will keep many babies in harm’s way,” Richard Trumka Jr., a commissioner of the U.S. Consumer Product Safety Commission said in response to the recall.

He said Fisher-Price is offering consumers “only a small portion of the product’s cost” and that “this dangerous approach will keep babies at risk of death just to save Fisher-Price money—a horrible example of putting profit over people.”

“My advice: get your $25 refund and then throw this product away; do not keep it in your homes because even after the so-called ‘repair’ this product will still be unsafe for infant sleep,” he added.

The Snuga Swings were sold at Amazon, Toys R Us, Walmart/Sams Club, and Target nationwide from October 2010 until January 2024.

Since 2010, approximately 2.1 million were sold in the US, about 99,000 in Canada and about 500 in Mexico. 

Fisher-Price has recalled a number of its infant products over safety fears in recent years.

In 2019, it recalled millions of Rock ‘n Play Sleepers after 30 baby deaths were linked to the product.

These were mostly attributed to babies rolling onto their tummies or sides while using the portable bassinet.

Another eight deaths have followed since, prompting Fisher-Price to remind customers about the recall.

Snuga Swing Recall

  • The recalled Snuga Swing is an infant swing with a front to back and side-to-side motion. The swing has 90 degrees of rotation, two seat back positions and folds up for storage.
  • Consumers should immediately remove both the headrest (by cutting the tether) and the body support insert from the seat pad before continuing to use the swing.
  • Fisher-Price will provide a $25 refund to consumers who remove and destroy the headrest and body support insert.

In total, the company has received reports of at least 100 infant deaths linked to the Rock ‘n Play. 

Another four baby deaths have been linked to Fisher-Price’s Rock ‘n Glide Soother — a baby seat that vibrates and moves back and forth.

This product was recalled in 2021.

The company recalled its Soothe ‘n Play Gliders at the same time, though no deaths were linked to the product.

Of the recalls, Trumka said, “Instead of fretting about its sales and reputation, Fisher-Price should be placing safety first and considering the science on infant safety.”

Kirk Herbstreit reveals he is leaving College GameDay in Week 7 following Lee Corso absent fears

KIRK Herbstreit has revealed he is leaving College GameDay early in Week 7.

The ESPN analyst is heading to Eugene, Oregon, for the Saturday morning show.

He will be joined by Pat McAfee, Rece Davis, Chris Fowler, Nick Saban and Co on the broadcast.

They will be in front of a wild crowd for the Ohio State Buckeyes and Oregon Ducks game.

The clash will see the number two and three ranked teams in the country go at it.

But Herbstreit has announced that while he will be on College GameDay, it won’t be for the whole show.

He mixes his time up with also being a color commentator on ESPN.

And he has to head off to call the huge ‘Red River Rivalry game’

That will see the Texas Longhorns take on the Oklahoma Sooners.

They are the number one and 18th ranked teams in college, respectively.

Herbstreit will be in the booth with play-by-play commentator Flower.

Holly Rowe and Laura Rutledge will be on sideline reporting duties for the showdown.

It is around 2,000 miles between Eugene and the Cotton Bowl stadium in Dallas, Texas.

This will mean he will need to leave around an hour early, to make the 3.30pm ET time kick-off.

“Ironically, Chris Fowler, I’m leaving GameDay like an hour early, in the middle of the show,” Herbstreit said.

“I’m going to have to make it, because our OU-Texas game starts at 3:30.

They have called for him to retire, having been a regular on it for around 35 years.

It recorded under-fire manager Erik ten Hag’s team talks for the crunch Premier League game.

Aston Villa immediately launched an investigation after The Sun alerted the club yesterday.

A source said: “This is a shocking breach of security and some serious questions will be asked as to how this was allowed to happen. Fortunately, there was nothing sinister to this incident.

“It was just a prankster, who’s actually a United fan, being silly and wanting to hear what was said inside those four walls. But it will definitely be a cause for concern about how they managed to get inside a changing room at one of the Premier League’s biggest clubs just days before a match.”

The Sun has heard the recordings but is choosing not to publish details of them.

However, we can reveal Ten Hag’s instructions to the team and individual players can clearly be heard.

The Sun understands the prankster used a phone from China that has a setting where a microphone can be activated by calling it from another device.

He had sticky-taped the handset somewhere out of sight in the United dressing room and only rang it when he knew the manager would be in there.

High alert

Sources claimed the culprit responsible even had the nerve to collect the device on Monday.

It is a similar stunt to the one that saw a Match of the Day studio hit with porn noises while live on air in 2023.

That was the work of Daniel “Jarvo” Jarvis.

However, it is believed that he had no involvement in the Villa recordings.

The latest stunt comes with Premier League chiefs already on high alert after a string of pranks targeting stadiums and teams.

In May, United were targeted by YouTuber Lizwani – who previously got on stage at the Baftas alongside the Oppenheimer cast.

He managed to sneak on to the Red Devils’ team bus after a 4-0 hammering at Crystal Palace’s Selhurst Park.

Lizwani brazenly took a seat before he was removed.

That breach led to Prem bosses firing off alerts to the top flight’s 20 clubs advising them to watch out for similar stunts.

A source said: “These people are mostly harmless and doing it for a bit of fun.

“They are doing it to get a load of hits on YouTube and make their fans laugh. They aren’t trying to cause trouble or do harm to anyone.”

Manchester United have suffered their worst start to a Premier League season, sitting in 14th on just eight points after seven games.

Ten Hag, 54, told the media after the game at Villa he was “very pleased” with the performance.

It came off the back of a 3-3 draw at Porto in the Europa League – where they blew a 2-0 lead – and a 3-0 pummelling by Spurs at Old Trafford.

Seven hour meeting

The Villa 0-0 was the Red Devils’ fifth game without a win – their last being a 7-0 Carabao Cup win over League One side Barnsley.

It is a far cry from the glory days of former manager Sir Alex Ferguson, who famously called high-pressure moments “squeaky bum time”.

The United hierarchy — including co-owner Sir Jim Ratcliffe — held a seven-hour meeting at Old Trafford last week with Ten Hag’s future up in the air.

They have remained silent over the manager’s position, with Sir Jim recently failing to publicly back him.

However, Ten Hag — currently on holiday during the international break — insists he still has the bosses’ support.

He said: “I don’t have any idea that is different because they should have told me.

“We communicate — very open, very transparent. I would say every day we talk, so I expect I will speak with them.”

He dismissed the “external noise”, adding: “Internal, we are disappointed.

“We know we have to do better. Especially, we need to score more.”

In 2016, Old Trafford suffered a bomb scare after a dummy device planted by a security company was found in a a toilet.

The fiasco led to United’s Premier League game against Bournemouth being called off.

Porn stunt on Match Of The Day

MATCH of the Day viewers were stunned to hear porn noises during the show in another phone prank.

They were coming from a device stuck to a wall by Daniel “Jarvo” Jarvis before a Wolves-Liverpool FA Cup tie at Molineux in 2023.

He activated its speaker remotely from another device during the live broadcast, to the amusement of presenter Gary Lineker.

Jarvo, also behind a string of other pranks at major sporting events, told The Sun at the time: “These things are all about confidence. If you hesitate, then you’ll get asked questions. People from Wolves thought we were with the TV, and vice versa.”
