TIME is running out for Americans to claim their share of a $7.67million food poisoning settlement.

If you purchased, received, or consumed Daily Harvest’s French Lentil + Leek Crumbles in 2022 and suffered injuries or financial losses as a result, you could receive up to $173,330 in compensation.

The crumbles, sold online and in retail locations in Chicago and Los Angeles, were found to contain tara flour, an ingredient allegedly contaminated with salmonella.

The recall, initiated in June 2022, followed an investigation by the FDA, CDC, and state health officials into reports of serious gastrointestinal and gallbladder-related illnesses linked to the product.

The FDA has received 393 reports of illnesses, with 133 hospitalisations across 36 states, according to its official website.

Plaintiffs in the lawsuit claim Daily Harvest failed to test the tara flour before use, exposing consumers to dangerous bacteria.

While Daily Harvest denies any wrongdoing, it agreed to the multimillion-dollar payout to resolve the allegations.

How much can you get?

The settlement offers different payouts depending on the severity of the injury or loss.

Those who suffered monetary damages tied to another person’s injuries classify as Category 1A and can get up to $665.

Anyone who experienced personal injuries but didn’t seek medical treatment can claim up to $1,335 under Category 1B.


If you qualify under Category 2, it means you can claim up to $20,000 if sought medical treatment but were not hospitalized.

Those who were hospitalized fall under Category 3 and can claim up to $40,000.

And individuals who underwent gallbladder removal surgery related to the contamination can claim up to an eye-watering $173,000 under Category 4 of the settlement.

What do you need?

To qualify, you’ll need documentation, such as receipts, medical records, or bills, to prove your purchase or injuries.

The deadline to submit your claim form is January 21, 2025.

If approved, payments may be adjusted based on the number of claims filed.

This settlement follows a larger $22.99 million payout Daily Harvest agreed to in 2024 for similar claims.

The final hearing for the current settlement is scheduled for March 3, 2025.

Consumers who still have the crumbles in their freezers are urged to throw them away immediately.

Daily Harvest emphasized that no other products were affected, and the crumbles are no longer available for sale.
